I. Introduction and Definitions

1. noblemed GmbH offers under domain nobledoc.com a website, which presents a network of providers and recipients of medical services. We are not a provider of medical services and treat no patients ourselves, but merely provide a platform for communication between users who offer medical services or receive and need to exchange medical data, such as doctors, therapists, companies, universities, and patients.

 

2. A user is anyone who uses our services, regardless of registration, account, or status.


3. An anonymous user is anyone who uses our services without registration or login.
 

4. A patient is any user who receives a medical service through our website, regardless of whether he or she is registered as a user and is suffering from a disease or not.
 

5. A non-approved provider according to to I.6, is a registered medical provider that has not yet proved his or her identity by upgrading his or her account.
 

6. A medical provider is a user who has in the specified location/country the permission of a competent authority that allows him or her to offer in his place/country any medical service, such as doctors, pharmacists, nurses, lab technicians, and biologists. Without such permission, the user is not allowed to register as a medical provider.
 

7. An expert is any medical provider who has received the status of an expert from us for a specific experience or education, allowing him or her to support other providers with his or her knowledge.
 

8. A corporation is any user who represents any medical organization (such as a university, society, or chamber) or company (such as a seller or manufacturer of medical products) and has permission from the responsible authorities in his country.
 

9. A profile or account is the appearance of a user to other users. The profile or account determines which functions a user has.
 

10. A non-approved patient is any user who is registered in the patient area as a patient, but his or her identity has not been verified by paying annual fees.
 

11. An approved patient is any user who is registered as a patient and his or her identity has been verified by annual payment of annual fees.

 

 

II. Requirements and Obligations

1. Registering as non-approved provider, provider, or corporation is done in the medical provider area on the website and is only permitted for providers of direct medical services (e.g., therapeutic, biological, etc.) or indirect medical services (e.g., business, scientific, etc.).


2. Account upgrades and using our services as a provider, expert, or corporation are possible only for those users who have a current license from the competent authorities in the country in which they are allowed to exercise their services. Users are required to immediately provide their permission to us upon our request.
 

3. An upgrade request for a non-verified provider is usually accepted when copies of the following proofs are submitted:

  1. identity card or passport or

  2. medical degree or a document from the competent authorities in your own country that allows you to practice the profession you want to upgrade to on our website.

 

4. A request to upgrade a provider account to an expert account is usually approved if the following conditions are met:

  1. The user has a provider account.

  2. The user has a minimum of 15 years’ experience in his or her field of focus.

  3. The user published as a main author at least five scientific studies on the focus area.

  4. The user has worked at least five years in an educational institution as a lecturer or professor, or has participated as a main lecturer in at least five major scientific conferences in his or her field of focus.

  5. If we are interested in taking the user as expert.

  6. If the provider does not meet the above requirements, but is holding a special ability and believes he or she can help other providers, then he or she should make this clear when applying for the upgrade. In this case, we study his or her request and, if we are interested, create a commission that examines the provider and decides on his or her upgrade request.

 

5. The upgrading of a non-approved provider account to a corporation account is usually confirmed when the following proofs have been submitted:

  1. ID card or passport of the registrant.

  2. A proof that the corporation is officially registered in its country, such as extracts from a commercial register or approval from regulatory authorities.

  3. A certificate for the management of the corporation stating that the registering person is authorized to open the account for the company through our website.

 

6. We reserve the right to verify certain users in our own ways and without the submission of any proofs.
 

7. The registration or use of our services as a patient is possible for anyone who needs medical service through our website.
 

8. We reserve the right to reject any upgrade request without giving any reason.
 

9. The opening and upgrading of a patient’s account for each user is possible without submitting any documents.
 

10. We reserve the right to refuse the registration of certain users and to block or delete their accounts, especially if these users do not comply with our terms and conditions and the rules contained herein, or if their identities could not be verified.
 

11. The user declares with his or her registration that he will neither use our services abusively nor help others to do so.

 

 

III. Working Period, Support, Modification, and Withdrawal of Service

1. The use of our website is available 24 hours a day.

2. Our team is reachable from Monday to Friday, excluding holidays, from 9 am to 5 pm German time.

3. Unless otherwise agreed, communication between us and users will be through the relevant contact and support forms. A direct telephone call is not allowed, and may only be used in the most urgent cases.

4. We reserve the right to change parts of our service or the service as a whole without special notice, or to cease the publication of the page temporarily or permanently. Claims do not accrue to users thereof.

 

 

IV. General Rules for Use

1. Our platform can be used by all users according to these rules. If you breach any of these rules, we reserve the right to block the user without warning and delete or disable his or her account, including all of the contents thereof. The user has in case of infringement no right to any refund or compensation. He or she remains responsible for the suffered or incurred damage. Should we or a third party suffer any damage from a breach, the user is obliged to pay for the damage.
 

2. The different user accounts are to be registered only by authorized users according to Section II. If a user registers without justification or gives wrong information, this will be considered fraud against us. In this case, the user is responsible for all consequences of his or her fraud against us, as well as against other users.
 

3. Transparency and authenticity are expected in the specified user data. Registration and any application are restricted to true information. The use of false personal or professional information is strictly prohibited. We make every effort to verify the data, but it is not always possible to check all the information on authenticity. Once we become aware of any data fraud, the affected user account, including all activities, will be deactivated directly. We reserve the right to bring an action against the user, even if no damage is caused. The real user who has given the wrong information is solely responsible.
 

4. User accounts are purely personal accounts and should not be given to any third parties or used by third parties, even if the user agrees to it. These include the direct or indirect delivery of access data, such as password and email. However, a corporation account is an account of a corporation and can be handled according to the decisions of management to third parties. Not affected by this regulation are accounts that are enabled but have not been used, such as the prepaid accounts of account packages that can be purchased from a provider to forward to patients.
 

5. Although our services are provided in multiple languages, we translate no medical texts for users and therefore are not liable for translation errors of any kind. We warn against automatic translation of medical texts, and do not accept responsibility when a user chooses such a translation. Similarly, we assume no responsibility for translations by third parties, even if we published the translation. All documents sent to us, especially for the purpose of account upgrade, should be in one of the languages ​​that we offer.
 

6. Account upgrades and downgrades are done as follows:

  1. Any non-approved provider can let his or her account be upgraded to a provider or corporate account, as long as he or she meets the relevant requirements according to Section II.

  2. When requesting an upgrade to a provider or corporation account, the user is prompted to upload documents such as identity cards, certificates, and work authorizations so that we can verify the authenticity of the request. In case of uploading insufficient documents, the user is contacted by us personally so that the missing documents can be submitted. The user should respond to the request and submit the documents within a period of 30 days. If he or she does not comply with this request, we will decide on the request after conducting our own research.

  3. Only after the upgrade and payment of annual fees, if there are such, will the user be visible and discoverable on our platform by other users. At the same time, the new features of the account will be activated by the upgrade.

  4. An upgrade request can only be made once. If we decline an upgrade request, the user has no right to request the same upgrade again.

  5. A downgrade is automatic to a non-approved account when the account fees are not paid on time. However, the data remains in the account until the fees are paid. After payment of the fees, the account is automatically reactivated.

 

 

V. Use as a Patient

1. The patient may use our platform to create his or her own online medical file, to keep his or her medical data, to network with our own medical providers internally, and to communicate better with them, as well as to ensure that therapists in emergency cases have direct online access to his or her medical data.
2. The registration of a non-approved patient account should be done only in the patient’s area. The activation of the account takes place automatically after authentication of the email of the registrant. Then, the patient is given an account with the following properties:

  1. A non-public profile, in which the patient can save medical data, including reports, radiographic findings, or other files.

  2. Patient identification card: The patient can print from his or her profile a double-sided medical card, which summarizes his or her medical data. This card includes access to the patient's profile. It is intended to allow each doctor to have access to the patient's medical data in a short time, and to connect him or her directly with other providers and with the family of the patient. The patient is responsible for the accuracy and regular updating of the documents and the data in his or her profile.

  3. This account is active and free of charge for an unlimited amount of time.

3. If the patient wants to communicate interactively with his or her medical providers via our platform, then he or she must upgrade his or her account to an approved patient account. The upgrade is automatic after the payment of the account fees. The approved patient has an account with the following properties:
a. A non-public patient profile that is only visible to the providers that have been previously added to the Doctors List of the patient.
b. Doctors List: The patient may invite his or her medical providers that are registered on our website to his or her Doctors List. After the provider accepts the invitation, he or she will automatically appear on the patient's Doctors List.
c. Threads: Each patient is allowed to open an unlimited number of threads under treatment, and add to each thread one or more of his providers from the Doctors List, which then communicate with each other and, with the patient there, send documents, plan treatment together, or make appointments for the patient.
d. This account is automatically activated for an annual fee of €50, and is automatically renewed every year after repayment.

 

VI. Use as Non-Approved Provider

1. This account is for the purpose of medical providers discovering and trying our platform.
 

2. The activation of a non-approved provider account occurs automatically after registering in the medical provider area, as well as authentication of the provider’s email.
 

3. Such an account is not binding and may at any time be blocked or deleted without explanation from us, including all its content.
 

4. This account has the following features:

  1. Profile: No public profile, and cannot be found on our website.

  2. Treatment: Users may open any number of patient threads and add only experts on these threads for payment.

  3. Colleagues List: The user has no authority to invite other providers to the Colleagues List or to be invited by other colleagues.

  4. My Patients List: Patients cannot invite this user to their Doctors List; this is why the My Patients List is deactivated.

  5. Offers: User cannot make any offer him or herself, but can read available offers from other users.

  6. Knowledge: Users cannot make any inputs in the Knowledge rubric, but can only read the available input of other users.

  7. Jobs: Users may not place any announcements in the Jobs rubric, but may only read available announcements of other users.

 

5. This account is active and free of charge for an unlimited period of time.

 

 

VII. Use as a Provider

1. This account represents an alternative and modern method of communication between medical providers and patients.
 

2. Each non-approved provider may upgrade his or her account to a provider account, as long as he or she fulfills the criteria mentioned in Section II and meets the other conditions. The activation of such a user account takes place after data and documents are submitted.
 

3. This account has the following features:

  1. Profile: The user has a public profile, which is findable by other users.

  2. Treatment: This user can open unlimited number of patient threads for free, and share them with an unlimited number of colleagues from the Colleagues List for no cost, or add for fees experts to discuss the case. Flat rate accounts are exempt from paying to add experts.

  3. Colleagues List: Users may invite other providers to his Colleagues List, and can be invited as a colleague of other providers. However, he or she may not add experts as colleagues. The experts will be automatically added to this list once the user has added an expert to a thread and has paid the adding fee.

  4. My Patients List: In this area, the service provider has a list of approved patients, who added him to their Doctors List.

  5. Offers: The user may post every three months one offer for free; more offers than this are chargeable. He or she is allowed to read available offers of other users in the same country.

  6. Knowledge: The user may post in the Knowledge rubric for free and may also read the available input of other users.

  7. Jobs: The user may make announcements every three months in the Jobs rubric for free. More announcements are chargeable. The user can read available announcements of other users in the same country.

 

4. A fee of €150.00 must be paid annually for this account. In case of a lack of payment, the account will automatically be downgraded to a non-approved provider account until payment is made. The account is valid for one year and is automatically extended by payment of the fee for one more year.

 

 

VIII. Use as an Expert

1. This account is suitable for providers who have great experience in one or more fields, and want to help colleagues and patients with their experience.
 

2. Each provider may request the upgrading of his or her account to an expert account if he or she fulfilled the permissions and conditions mentioned in Section II. The activation of an expert account is done by us after checking the data given.
 

3. This account has the following features:

  1. Profile: The expert has a public profile as an expert, and can be found by other users as an expert.

  2. Treatment: The expert may open any number of patient threads and add colleagues from his Colleagues List to these threads to exchange patient data.

  3. Colleagues List: The expert is allowed to add other service providers and experts as colleagues, and may be invited to Colleagues Lists of other experts, but cannot be invited by providers as a colleague.

  4. The My Patients List is not available for this account, as patient–expert communication should not exist on our website to ensure that the expert takes care of patients of providers so that his or her time can be used more effectively. If the expert is interested in the use of our platform as a provider, he or she may open a second account as such.

  5. Offers: The expert may make an offer for free every three months; more offers than this are chargeable. He or she is allowed to read available offers of other users in the same country.

  6. Knowledge: The expert can make an unlimited number of inputs to the Knowledge rubric for free. The expert may also read the available inputs of other users.

  7. Jobs: The expert may make announcements in the Jobs rubric one time every three months for free. More announcements are chargeable. The user may read available announcements of other users in the same country.

 

4. The account is open for an unlimited time and is free of charge, as long as the expert responds to a minimum of three threads of three providers every three months free of charge, and we are interested in cooperation with him or her.

 

 

IX. Use as a Corporation

1. This account is suitable for users who wish to represent educational institutions, organizations, or companies so that they reach other participants in healthcare easier. The purpose of this account is to make it easier for corporations to look for employees, do research projects, promote events, and reach customers faster, easier, more environmentally friendly, and cheaper.
 

2. Each non-approved provider may upgrade his or her account to a corporation account as long as he or she fulfills the requirements and meets the conditions mentioned in Section II. The activation of such a user account is done by us after reviewing the data and documents submitted.
 

3. This account has the following features:

  1. Profile: The corporation has a public profile, which is findable by users.

  2. Treatment: The corporation cannot open any patient threads and cannot be invited to such threads.

  3. Colleagues List: The corporation has no Colleagues List, and may not be invited to Colleagues Lists.

  4. Offers: The corporation may make one offer for free every three months; more offers than this are chargeable. The user is allowed to read available offers of other users in the same country.

  5. Knowledge: Users can publish unlimited input under the Knowledge rubric for free. The service provider may also read available displays of other users.

  6. Jobs: The user may make one announcement in the Jobs rubric every three months for free. More announcements are chargeable. The user may read available announcements of other users in the same country.

 

4. A fee of €300.00 should be paid annually for this account. In case of lack of payment, the account will automatically be downgraded to a non-approved provider account until payment is. The account is valid for one year and is automatically extended by payment of the fee for another year.
 

5. Educational institutions, such as universities, and nonprofit medical organizations can get a completely free flat rate account. We take the decision of opening such an account upon request before, during, or after the upgrade to corporation account.
 

6. The account is intended for individuals who want to represent their corporations; therefore, all our system bills are provided with 19% VAT.
 

7. For corporations operating in the European Union, such as companies willing to pay the VAT for our service in their own countries, and needing a bill without the German 19% VAT, we offer the flat rate feature, in which a single annual fee is paid for using all our features.

 

 

X. Account Flat Rate

1. Account Flat Rate is an additional bookable function that makes all our services free through one annual payment.
 

2. This feature can be booked informally by any medical provider or corporation through our support form. Prices depend on the type and use of the account.

 

 

XI. Account Packages for Patients

1. We offer medical practices, hospitals, or companies patient accounts in packages to eliminate annual fees. After payment of the package price, the medical provider receives a table with access information for a number of pre-activated patient accounts.

 

2. These access data can then be forwarded by the buyer to his or her patients. After logging in, the patient should replace the previously saved access data and user data with their own data.
 

3. This account package remains active as long as the buyer pays the annual fees. In case he or she does not pay, all accounts will be dissolved and converted to normal verified patient accounts, which can be paid by the patient him or herself. Otherwise, they will be downgraded to non-approved patient accounts.
 

4. The service provider may separate some accounts of the package from the remaining accounts. In this case, he must send us the user ID.

 

 

XII. Patient Threads and Treatment

1. This feature is available only to providers and experts, enabling them to open threads for their patients/issues, and to add to each thread certain colleagues and experts who exchange information and files about the patient/issue.

 

2. Patients can open threads to communicate with one or more medical providers. They may only add them from the My Doctors list, but they cannot communicate with experts.
 

3. The thread holder is the one who opened it. He or she and his or her colleagues in the thread may not publish any personal patient data or exchange medical files without the express written consent of the patient or his or her legal authorized representative. This consent should include the following text:


“I (patient name, address, date of birth) release NobleDoc and the following medical providers from medical confidentiality laws (name of the service provider(s)) and agree that they may exchange my relevant personal and medical information and documents through the NobleDoc web platform with other members for the purpose of treatment, especially as related to the following findings: (findings description and date). I have read and agree with the terms and conditions, privacy policy, and disclaimer of www.NobleDoc.com. I am aware that I can withdraw this agreement at any time in the future. (Date, Signature)”

 

4. All medical details in this thread should correspond to the truth and be entered to the best of the user’s knowledge and belief. Exceptions to this rule are names, which may be replaced by the user with their own coding system to anonymize the patient identity as much as possible.
 

5. The thread holder should invite only trustable users to the thread in order to prevent data abuse.
 

6. To ensure that everything remains serious and safe, threads, including all entries, cannot be deleted or modified by users. In case of entry mistakes, the correction must be done by a new entry on the same thread, or by opening a completely new thread and closing the old one.
 

7. The thread holder may add to this thread colleagues from his Colleagues List. Experts, however, may only be added after paying €10.00 + 19% VAT. This fee does not need to be paid by accounts with the flat rate feature.
 

8. All account fees and the fees that are paid to us by the user when adding an expert do not include any charge for the services of the added users and experts. Although we advise providers and experts to answer threads for free to help colleagues and patients, some may request payment from the user. In this case, we have no influence on this payment request, and are not responsible for payment or for performing the service. All payments to us are payments for connecting users but not for their performance or service. Before adding an expert to any thread, our site displays the activity of the experts in the field of treatment as soon as this information is available. The user alone is responsible for which experts he or she adds. We accept no responsibility if the expert or colleague does not reply to the thread.
 

9. In case that an expert or a provider requests a payment for his service on our website, then he or she should request the payment clearly before starting to perform the service. If he or she demands no payment before performing this service, then this service must be free of payment and he or she must not demand any payment afterwards. The provider should describe his service, including payment amounts, deadlines, and payment details, exactly in the thread. We advise users not to start any agreement when all these details are not clearly defined.
 

10. For all agreements between the different users of our website, we assume that the agreeing parties comply with the rules of their home countries, and have permission to offer this service for payment and to send the other user a proper invoice with the applicable taxes. Those who do not fulfill this requirement have no right to offer paid services on our platform.
 

11. Each user is pointed out expressly to examine the responses in the field of treatment carefully and treat it only as advice. The user is ultimately personally responsible for implementing the advice of other providers and experts. It is strictly prohibited for users to give any wrong advice in any case.
 

12. We are not liable for any dispute because of payments or false consultations, including all consequences; only the user who caused the dispute is liable. Our platform connects service providers, and accepts no responsibility for their services.
 

13. Deleting threads is available upon request of the thread holder. For this, the user must send us a message with a link to the thread through our support form. Alternatively, an email can be sent to info@nobledoc.com. The notification should explicitly show the desire for deletion.

 

 

XIII. Colleagues List

1. The Colleagues List is a list of providers and experts who care for common patients. This list is only available for providers and experts.
 

2. Providers may invite other providers as colleagues. Once the colleague has accepted the invitation, he or she will automatically appear on this list. Providers, however, may not invite experts as colleagues, while experts may invite providers as colleagues.
 

3. Even if an expert is on the Colleagues List of provider, adding this expert to a thread is a chargeable service.

 

 

XIV. My Patients

1. This is an area in the provider account that includes a list of verified patients who added the provider to their My Doctors list. These are patients with whom the provider usually communicates.

 

2. A patient appears in the list only if the provider accepted his or her invitation. The provider could delete the patient from this list at any time. The patient could do the same with the provider.

 

 

XV. My Doctors List

1. This is a list of approved providers that have been added by verified patients as their own providers. This list is only available for verified patients.
 

2. The patient authorizes providers listed here to access his or her profile and see his or her saved data.
 

3. The patient may invite these providers to their own threads and communicate internally with them. He or she may at any time remove from them from the list.

 

 

XVI. Offers

1. Offers include commercial announcements on our platform in the Offers area. They represent offers of different kinds.
 

2. We allow providers, experts, and corporations to announce business, exhibitions, and products in three categories.
 

3. Every user mentioned in Section XVI.2 may publish an offer every 90 days for free; more offers than this are chargeable.
 

4. The user determines when his or her offer starts and ends. The entry remains editable for a week after being saved.
 

5. All offers are country-based; they only appear to users in the same country, but stay hidden for registered users in other countries.
 

6. Offers only appear when an account is active. If the account is disabled for any reason, all offers are automatically disabled. If the account is reactivated, offers are automatically reactivated.

 

 

XVII. Inputs in Knowledge

1. Knowledge inputs are input onto our website in the Knowledge field. They represent publications of different kinds. Each published input presents a contribution of the user to enhance the knowledge of other users, and is intended to include only correct and authentic scientific information.
 

2. We allow approved providers, experts, and corporations to publish their own articles, opinions, medical events, and research projects.
 

3. The user mentioned in Section XVI.2 can add unlimited input in this area, as long as these inputs communicate scientific information to other users.
 

4. Advertising for products is not permitted in this area. Announcing for products in this area is a reason for temporary or permanent deactivation of the user account.
 

5. The input appears to worldwide users, irrespective of their country of residence.
 

6. Inputs appear only if the account is active. If the account is deactivated for any reason, inputs are usually automatically deactivated. If the account is reactivated, they are reactivated automatically.

 

 

XVIII. Job Announcements

1. Job announcements are announcements on our website in the Jobs rubric. They represent job offers.

 

2. We allow providers, experts, and corporations to post announcements in the Jobs rubric.
 

3. Each user may publish one announcement every 90 days free of charge; more announces than this are chargeable.
 

4. The user determines when his announcement must be active. The announcement remains editable for one week after being saved in our system. It cannot be changed after this one-week period.
 

5. All announcements appear to users registered in the same country, and remain invisible for users registered in other countries.
 

6. All announcements appear only when the account is active. If the account is deactivated for any reason, the announcement will be automatically deactivated. If the account is reactivated, they are reactivated automatically.
 


XIX. Double Accounts

Keeping more than one account of the same kind for the same person is strictly prohibited. The opening of multiple accounts of different types is allowed. A person may, for example, not have two patient accounts, but he or she may have a patient account, a provider account, and a corporation account simultaneously.
